Each evaluation is conducted with precision, ethical care, and respect for all parties involved. All assessments adhere to current professional standards.

01
Competency to Stand Trial Evaluation Criminal

A competency evaluation assesses whether a defendant has a sufficient present ability to consult with counsel and a rational and factual understanding of the proceedings against them. This evaluation is requested by the court or defense counsel and is conducted in accordance with Montana statute.

Overview of the Process
  • Initial referral and review of available legal and psychological records
  • Clinical interview with the defendant in a private setting
  • Administration of validated forensic assessment instruments
  • Scoring, interpretation, and integration of all data sources
  • Preparation and delivery of a written forensic report

The general process above is a rudimentary overview. Each evaluation is individually tailored to the referral question and specific circumstances.

02
Sanity / Mental State at Time of Offense Evaluation Criminal

This evaluation examines the defendant's psychological state at the time the alleged offense occurred, including whether a mental disease or defect may have impaired their capacity to appreciate the criminality of their conduct or to conform their behavior to the law.

Overview of the Process
  • Review of police reports, witness statements, and prior records
  • Clinical and forensic interview examining mental state history
  • Collateral interviews where appropriate and available
  • Psychological testing as warranted
  • Written forensic report with clinical and legal opinions

Each MSO evaluation is complex and highly individualized. Timelines vary based on record availability and case complexity.

03
Psychosexual Evaluation Civil · Criminal

Psychosexual evaluations assess sexual history, behavior patterns, risk factors, and amenability to treatment in individuals facing charges or civil commitments related to sexual offenses. These evaluations assist courts and treatment providers in making informed decisions.

Overview of the Process
  • Review of legal records, prior evaluations, and treatment history
  • Comprehensive clinical and psychosexual interview
  • Standardized risk assessment instrument administration
  • Integration of all data with applicable research literature
  • Detailed written report with risk level and treatment recommendations

Confidentiality limits apply and are explained thoroughly prior to the evaluation beginning.

04
Parenting / Child Custody Evaluation Family Court

Custody evaluations provide the court with an objective professional assessment of parenting capacity, the psychological needs of the child, and the ability of each parent to meet those needs. The best interests of the child remain the central focus of this evaluation.

Overview of the Process
  • Individual interviews with each parent and the child(ren)
  • Parent-child observation session(s)
  • Psychological testing for each parent
  • Collateral interviews and record review
  • Comprehensive report with parenting plan recommendations

This evaluation is ordered by the court or agreed to by stipulation. It typically requires multiple appointments across several weeks.

05
Violence / Dangerousness Risk Assessment Civil · Criminal

Risk assessments evaluate the likelihood of future violent behavior using structured professional judgment and empirically validated risk assessment tools. These are used to inform sentencing, civil commitment, release planning, and treatment decisions.

Overview of the Process
  • Thorough record review including criminal, medical, and psychiatric history
  • Semi-structured clinical interview
  • Administration of empirically validated risk assessment instruments
  • Structured professional judgment integrating all findings
  • Written report with risk formulation and management recommendations

Risk assessments are probabilistic, not predictive, and always contextualized within the current research base.

Frequently Asked Questions
Does my insurance cover a forensic evaluation?
In most cases, no. Forensic evaluations are conducted for legal purposes — not treatment — and are therefore generally excluded from health insurance coverage. The retaining party (attorney, court, or individual) is typically responsible for the fee.
How long does an evaluation take?
This varies by evaluation type and complexity. In-person interview time can range from 2–6 hours, and the full evaluation process (including report writing) may take 1–4 weeks from initial contact. Expedited timelines may be available for court deadlines.
Is what I say during the evaluation confidential?
Forensic evaluations have different confidentiality rules than therapy. Before any evaluation begins, you will be fully informed about the limits of confidentiality, who will receive the report, and how findings may be used in legal proceedings.
Can I request an evaluation without a court order?
Yes, private evaluations can be requested by individuals, attorneys, or other parties without a court order. The scope and use of such evaluations should be discussed with the evaluator and your legal counsel beforehand.
What should I bring to my evaluation?
You will receive specific instructions when your appointment is scheduled. Generally, you should bring a valid photo ID and arrive rested. Avoid caffeine or substances that could affect test performance. Records or documents can be sent in advance.
